This Refund Policy governs refunds for Subscriptions and other paid access to the VADIRA platform and related services (the "Services"). It is incorporated into, and forms part of, the Terms of Service. Capitalized terms have the meanings given in the Terms of Service.
1. Nature of the Services
1.1. VADIRA provides digital software services that are made available to you immediately upon activation of a Subscription. Because the Services are digital and access is granted instantly, they are, by their nature, generally not returnable.
1.2. By purchasing a Subscription, you acknowledge and agree that access is provided immediately and, to the extent permitted by Applicable Law, you consent to the commencement of the Services and expressly acknowledge that this may affect any statutory right of withdrawal.
2. General Rule
2.1. All fees are generally non-refundable, except where a refund is required by Applicable Law or is expressly granted under this Policy.
2.2. Subscriptions are licenses to access features for a defined period; they are not purchases of Digital Assets or guarantees of any transaction outcome.
3. Cryptocurrency Payments
3.1. Payments made in Digital Assets are settled on public blockchains and are irreversible. Once a cryptocurrency payment has been confirmed on-chain, it cannot be reversed by VADIRA.
3.2. Where a refund is approved for a cryptocurrency payment, the refunded amount, method, network, and exchange rate will be determined at our reasonable discretion, and network/gas fees may be deducted. Due to price volatility, the value returned may differ from the value originally paid.
3.3. VADIRA is not responsible for losses caused by payments sent to an incorrect address, in an incorrect amount, or over an unsupported network.
4. Limited Circumstances Where a Refund May Be Considered
4.1. At our sole discretion, we may consider a partial or full refund where: (a) a verified, sustained technical failure attributable solely to VADIRA prevented you from accessing the core Services for a material period and could not be remedied; or (b) a refund is mandated by Applicable Law.
4.2. Refunds will not be granted for, among other things: dissatisfaction with blockchain network conditions or gas prices; transactions that fail to confirm due to user-selected parameters or network congestion; user error; loss of keys, passwords, or Digital Assets; account suspension or termination resulting from a breach of the Terms of Service or the Acceptable Use Policy; or any unlawful use of the Services.
5. No Refund on Termination for Cause
5.1. If your Account is suspended or terminated because of a violation of the Terms of Service, the Acceptable Use Policy, or Applicable Law, you are not entitled to any refund, and any outstanding fees remain payable.
6. How to Request a Refund
6.1. To request a refund, contact us via Telegram within fourteen (14) days of the charge, providing your Account details, the transaction reference, and a description of the issue.
6.2. We will review eligible requests within a reasonable time and notify you of the outcome. Approval of any discretionary refund does not constitute a waiver of this Policy for future requests.
7. Chargebacks
7.1. If you initiate a chargeback or payment dispute without first contacting us and allowing a reasonable opportunity to resolve the matter, we reserve the right to suspend or terminate your Account and to contest the dispute.
8. Changes
8.1. We may modify this Refund Policy at any time. The version in effect at the time of your purchase governs that purchase, except where Applicable Law requires otherwise.
